SA Workcover Claims

WorkCover SA administers South Australia's no-fault Workers Rehabilitation and Compensation Scheme. In South Australia, all WorkCover SA claims are currently managed by Employers Mutual. To be eligible for compensation the injured worker must suffer a disability that arose out of or in the course of employment.

Employers Mutual will assess your claim, and if it is accepted, you may be paid compensation for:

  • reasonable medical treatment costs
  • rehabilitation, physiotherapy, gym, hydrotherapy
  • costs related to travel for the purpose of receiving medical services, hospitalisation or rehabilitation
  • therapeutic appliances and equipment aids
  • medications
  • nursing
  • weekly payments (income maintenance)
  • assistance for domestic care
  • child care
  • re-training

The amount of compensation that you will be entitled to depends on the extent of your injuries and disabilities, and the reasonable costs of treatment.

Compensation is available for physical and psychiatric injuries. Whether you have suffered a back injury, muscle strain, neck injury, RSI, carpal tunnel syndrome, hearing loss, fracture, scarring, burns, catastrophic injury, PTSD, depression or anxiety, our workcover claims solicitors can provide competent advice and representation in your case.

Adelaide Workcover Solicitor

You could lodge a claim on your own, without the assistance of a solicitor. However you should be aware that workers compensation laws are complex, and insurance companies are interested in making a profit (i.e paying workers the least amount of compensation possible). Having an experienced South Australian workers compensation solicitor running your case will ensure your best chance at receiving maximum benefits under the law.

Don't make the mistake of relying solely on advice from your insurance case manager; seek independent legal advice from an Adelaide workers compensation claim solicitor who specialises in representing the rights of injured workers.

Our workers compensation solicitors can:

  • Prepare and lodge your workcover claim, or death benefit claim on behalf of dependants.
  • Provide advice on lump sum payments for permanent disability.
  • Provide advice and representation for rejected, reduced or discontinued claims.
  • Advise on medical disputes regarding your injury and impairment.
  • File a Notice of Dispute with the South Australian Workers Compensation Tribunal.
  • Provide advice and representation in conciliation conferences and dispute management conferences.
  • Provide advice and representation in judicial determination hearings.
  • Advice and representation in appeals to the Full Bench of the Tribunal and to the Supreme Court.
  • Provide advice on disputes with your employer, for example, your employer is not providing suitable work or not co-operating with your return to work plan.

South Australia Time Limits

Strict time limits apply when making compensation claims in South Australia. You should notify your employer of your injury as soon as possible. A claim for compensation needs to be lodged within six months of the disability arising or 13 weeks for payments to commence on a provisional basis. In some circumstances you may be able to lodge a claim after this period. Contact our Adelaide workers compensation solicitors to discuss this if you need clarification. Free legal advice is available by sending an email, or completing the online Contact Form.
